Terms & Conditions

Infosoft (Kutumb Kart - www.kutumbkart.com) is a SaaS Platform and software development company. These terms govern how we design, build, and support custom subscription billing software, eCommerce solutions, and mobile apps for monthly and daily-delivery businesses, and what to expect when you engage us for a project.

Infosoft Technologies Private Limited (operating under the brand name "Kutumb Kart" via www.kutumbkart.com) ("Infosoft", "we", "us", "our") is a Pune-based SaaS Platform and software development company. We build custom subscription billing software, eCommerce solutions, admin dashboards, and mobile apps for recurring-order businesses — milk & dairy, newspaper, laundry, tiffin, water jar, salon, flower delivery, car washing, and monthly car rental services. By visiting our website, requesting a proposal, or signing a service agreement with us, you ("Client", "you") agree to the terms below.

Getting Started

Acceptance of Terms

  • Browsing our website or submitting an inquiry means you accept these Terms & Conditions and our Privacy Policy.
  • A software development project only begins once both parties have signed a proposal, quotation, or service agreement outlining scope, timeline, and cost — these Terms apply alongside that agreement.
  • If there is any conflict between these Terms and a signed project agreement, the signed agreement takes priority for that specific project.
What We Build

Services We Provide

Infosoft designs and develops software tailored to subscription, eCommerce, and recurring-delivery businesses, including:

Custom Business Software

Subscription billing engines, customer management, and workflow automation built around your specific business model.

Mobile Apps

Android & iOS apps for customers to manage subscriptions and orders, and for delivery staff to manage routes and updates.

Web Applications & Dashboards

Admin dashboards to track payments, generate reports, and oversee day-to-day business operations.

Ongoing Support & Maintenance

Bug fixes, feature updates, and technical support after launch, based on the support plan agreed in your contract.

How Projects Work

Project Scope & Requirements

1

Discovery & Proposal

We study your current process (registers, Excel, or existing software) and share a written proposal covering features, timeline, and cost before development starts.

2

Scope Changes

Features not listed in the agreed proposal are treated as change requests. These may affect the timeline and cost, and will be quoted separately before we build them.

3

Approvals & Delays

Timelines depend on timely feedback and approvals from your side (content, designs, test data). Delays in approvals may extend the delivery schedule accordingly.

4

Testing & Handover

Before final handover, you get a testing/staging period to review the software and report issues, which we fix prior to go-live.

Fees, Payment & Refund Policy

  • Project fees, milestone-wise payment schedules, and any recurring maintenance/hosting charges are as stated in your signed proposal or invoice.
  • Development milestones (e.g. design approval, module completion, final delivery) begin only after the corresponding advance or milestone payment is received.
  • Late payments may pause active development work and delay your project timeline until dues are cleared.
  • Third-party costs — such as payment gateway fees, SMS/ WhatsApp API charges, app store fees, or domain/hosting renewals — are billed separately and are not included in the development fee unless stated otherwise.
  • Refund & Cancellation Policy: SaaS subscription charges and maintenance fees are non-refundable once the billing cycle has started. Cancellation requests must be submitted prior to the renewal date. For custom software development, milestone or advance payments are strictly non-refundable once work on that specific milestone has commenced.
Ownership

Intellectual Property & Code Ownership

Your business data, subscriber data, and branding always belong to you.

Ownership of the custom source code we develop for you transfers on full payment, as defined in your service agreement.

Infosoft retains rights to any pre-existing frameworks, internal tools, or reusable components used to build your software.

With your permission, we may reference your project as a portfolio example, without disclosing confidential business data.

Working Together

Client Responsibilities

  • Provide accurate business information, subscriber data, and content needed to build and test your software.
  • Review deliverables and provide feedback within reasonable timeframes to keep the project on schedule.
  • Ensure your team uses admin access, staff logins, and customer data responsibly and in line with applicable laws.
  • Obtain any required consent from your own subscribers before collecting their data through the software we build for you.
Beyond Our Control

Third-Party Integrations

Our software may integrate with third-party services such as payment gateways, SMS/WhatsApp APIs, cloud hosting, and app stores (Google Play, Apple App Store). These services have their own terms, fees, and approval processes. Infosoft is not responsible for outages, policy changes, or charges imposed by these third-party providers, though we will assist in resolving integration issues wherever possible.

After Launch

Warranties & Support

  • We provide a bug-fix warranty period after final delivery, as specified in your service agreement, covering defects in functionality we built and delivered.
  • The warranty does not cover issues caused by third-party services, changes made outside Infosoft, misuse, or features added outside the original scope.
  • Ongoing support, new features, and major updates beyond the warranty period are covered under your Annual Maintenance Contract (AMC) or support plan, if opted.
Fair Boundaries

Limitation of Liability

Infosoft works to deliver reliable, well-tested software, but we do not guarantee uninterrupted or error-free operation at all times. To the extent permitted by law, Infosoft's liability for any claim arising from a project is limited to the fees paid by you for that specific project, and we are not liable for indirect losses such as lost business or lost revenue arising from software downtime or third-party service failures.

Ending An Engagement

Termination

  • Either party may terminate a project agreement with written notice, as per the terms specified in your signed service agreement.
  • On termination, fees for work completed up to that point remain payable, and Infosoft will hand over completed deliverables upon settlement of dues.
  • Infosoft reserves the right to pause or discontinue support/hosting services if recurring fees remain unpaid beyond the agreed grace period.
